Agreement to Terms

By downloading, installing, or using apps published by Scheming Penguins ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our apps.

Description of Service

Rundown is an app that allows you to organize and view content from media servers you specify (such as Plex or Jellyfin). The app creates a TV-like viewing experience with scheduled programming, an electronic program guide, and continuous playback. The app connects to servers you configure and does not host or provide any media content itself.

Your Responsibilities

You are responsible for:

• Ensuring you have the right to access any media servers you connect to the app
• Ensuring you have the right to view any content accessed through those servers
• Complying with the terms of service of any third-party services you use with the app (Plex, Jellyfin, etc.)
• Maintaining the security of your device and any credentials stored on it
• Any content you access through servers you configure

Third-Party Services

Our apps integrate with third-party services that are not operated by us. These include:

• Plex — Media server platform (plex.tv)
• Jellyfin — Open-source media server
• The Movie Database (TMDB) — Metadata provider

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, content, or practices of these third-party services.

Intellectual Property

The app and its original content, features, and functionality are owned by Scheming Penguins and are protected by copyright and other intellectual property laws. Plex, Jellyfin, TMDB, and other third-party names and logos are trademarks of their respective owners.

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHEMING PENGUINS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR DEVICE OR DATA; (C) ANY THIRD-PARTY SERVICES OR CONTENT ACCESSED THROUGH THE APP; OR (D) ANY OTHER MATTER RELATING TO THE APP.

Indemnification

You agree to indemnify and hold harmless Scheming Penguins from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the app, your violation of these terms, or your violation of any rights of a third party.

Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for any reason, including breach of these terms. You may stop using the app at any time by uninstalling it from your device.

Changes to Terms

We may modify these terms at any time. We will notify you of any changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the app after any changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
